What is a trademark?

A trademark is a distinctive sign that serves to distinguish your products and your services from those of your competitors for a period of 10 years (renewable) and in a given territory.

How are these rights acquired?

Before filing an application for a trademark, it is advisable to perform a prior art search in order to make sure that the sign under consideration is available.

GPI & Associés is listed as Registered Trademark Representative before French (INPI), International (WIPO), and European (UEIPO) Trademarks Offices. GPI & Associés can also directly represent applicant before the German (DPMA) and the Spanish (OEPM) Trademarks Offices.

Defending your rights

GPI & Associés represents you in opposition proceedings before Trademark Offices.

Once your trademark is registered, we recommend settling a monitoring survey to detect third party trademark filings that might be identical with or similar to yours. When a trademark is detected, opportunities for legal proceedings and/or for amicable settlement with the adverse party are analysed.

Our Firm also assists you in defending your rights against third parties before the courts in close collaboration with Attorneys at Law dedicated to Intellectual Property, e.g. through GPI Avocats.
